BLUU KAZI — Terms and Conditions

- BLUU KAZI S.A. ("BLUU KAZI", "the Company", "we") operates a talent platform providing: (a) candidate sourcing and placement — pre-screened, certified cybersecurity, IT, and AI professionals delivered to employer clients; (b) training and professional development — certification advisory and training pathways for learners; (c) professional services — workforce advisory and related B2B services; and (d) the BLUU KAZI portal — accounts and tools for employers, job seekers, and learners, including a job board that combines direct postings with listings aggregated from public sources.
- By creating an account, submitting a form, posting a role, or purchasing any service, you accept these terms. The client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. In order to be valid, any derogation must be expressly agreed to in advance in writing.
- 2. Definitions
- "Client" or "Employer" means any business purchasing sourcing, posting, training, or professional services. "Candidate" means an individual who joins the talent network. "Learner" means an individual enrolled in or inquiring about training. "Placement" means a Candidate accepting an offer of employment or engagement with a Client introduced by BLUU KAZI.
- 3. Employer terms — sourcing and placement
- 3.1 Placement services are contingency-based unless otherwise agreed in writing: no placement fee is due until a Candidate introduced by BLUU KAZI is hired.
- 3.2 Replacement guarantee. If a placed Candidate's employment ends within ninety (90) days of their start date (other than by redundancy, restructuring, or material change to the agreed role), BLUU KAZI will source one replacement candidate for the same role at no additional placement fee. The guarantee is conditional on all invoices being paid when due.
- 3.3 Non-circumvention. If, within twelve (12) months of an introduction, a Client hires a Candidate introduced by BLUU KAZI — directly or through any affiliate or intermediary — without completing the engagement through BLUU KAZI, the full placement fee becomes immediately due.
- 3.4 Self-serve posting plans. Posting plans (e.g. Starter, Growth, Scale) grant a monthly quota of active job posts for the stated subscription period. Quotas reset at the start of each period; unused posts do not roll over. Periods renew by repurchase and are not prorated on upgrade. BLUU KAZI may unpublish postings that are misleading, discriminatory, unlawful, or outside the platform's technical scope.
- 3.5 Candidate information provided to Clients is confidential, provided solely for the evaluation of the specific role, and may not be shared with third parties or retained for other purposes.
- 4. Candidate terms — talent network
- 4.1 Membership of the talent network is free for Candidates. BLUU KAZI never charges job seekers placement fees.
- 4.2 Candidates warrant that profile information, certifications, and work-authorization details are accurate and current. Misrepresentation is grounds for removal from the network.
- 4.3 Candidate profiles are never sent to an Employer without the Candidate's knowledge. Consent to data storage and matching is collected at signup and may be withdrawn at any time, subject to our Privacy Policy.
- 4.4 BLUU KAZI matches and advocates but does not guarantee interviews, offers, or employment.
- 5. Learner terms — training and certification
- 5.1 Certification advisory is provided free of charge; paid training and examination fees are set out at enrollment.
- 5.2 Certifications are issued by independent bodies (e.g. EC-Council, CompTIA, ISC2). BLUU KAZI does not control and cannot guarantee examination outcomes, scheduling, or certification-body decisions.
- 5.3 Unless otherwise stated at enrollment, training fees are payable before course commencement and are non-refundable once course materials or examination vouchers have been issued.
- 6. Aggregated job listings
- The job board includes listings aggregated from employers' public job boards and public APIs. Such listings are identified as aggregated, link to the original posting, and remain the property of the originating employer, whose trademarks belong to them. Aggregated listings are provided "as is"; BLUU KAZI does not warrant their accuracy or continued availability. An employer may claim its listings (converting them to direct postings) or request their removal at any time via legal@bluukazi.com, and removal requests are honored promptly.
- 7. AI-assisted screening
- BLUU KAZI uses artificial intelligence to score, summarize, and rank applications and to draft communications. AI output supports human decisions and is always subject to human review: no rejection, placement, or other final decision affecting a Candidate is made by automated means alone, and no external communication is sent without human approval.
- 8. Invoicing and payment
- 8.1 Our invoices are payable within 21 working days, unless another payment timeframe is indicated on either the invoice or the order. In the event of non-payment by the due date, BLUU KAZI reserves the right to request a fixed interest payment amounting to 10% of the sum remaining due. BLUU KAZI will be authorized to suspend any provision of services without prior warning in the event of late payment.
- 8.2 If a payment is still outstanding more than sixty (60) days after the due payment date, BLUU KAZI reserves the right to call on the services of a debt recovery company. All legal expenses will be payable by the client.
- 8.3 Certain countries apply withholding at source on the amount of invoices, in accordance with their internal legislation. Any withholding at source will be paid by the client to the tax authorities. Under no circumstances can BLUU KAZI become involved in costs related to a country's legislation. The amount of the invoice will therefore be due to BLUU KAZI in its entirety and does not include any costs relating to the legislation of the country in which the client is located.
- 9. Obligations and liability
- 9.1 BLUU KAZI undertakes to do its best to supply performant services in due time in accordance with the agreed timeframes — including stated delivery targets such as finalist shortlists within 48 hours, which are service objectives, not guarantees. However, none of its obligations can be considered as being an obligation to achieve results.
- 9.2 BLUU KAZI cannot, under any circumstances, be required by the client to appear as a third party in the context of any claim for damages filed against the client by an end consumer, a candidate, or an employee.
- 9.3 Hiring decisions, employment terms, and workplace compliance remain the sole responsibility of the Client. Career decisions remain the sole responsibility of the Candidate or Learner.
- 9.4 To the maximum extent permitted by law, BLUU KAZI's aggregate liability under any engagement is limited to the fees actually paid by the client for the service giving rise to the claim in the twelve (12) months preceding it, and excludes indirect and consequential losses, including lost profits and loss of data.
- 10. Claims
- In order for it to be admissible, BLUU KAZI must be notified of any claim by means of a letter sent by recorded delivery to its registered office within 8 days of the delivery of the goods or the provision of the services.
- 11. Accounts, acceptable use, and data
- Account holders are responsible for the confidentiality of their credentials. Scraping the platform, misrepresenting identity or authority (including claiming listings for a company you do not represent), and posting unlawful or discriminatory content are prohibited and grounds for suspension. Personal data is processed in accordance with our Privacy Policy.
- 12. Intellectual property
- The BLUU KAZI name, logo, platform, AI scoring methodology, and site content are the property of BLUU KAZI S.A. Clients receive a limited license to use candidate reports internally for the evaluated role. Aggregated listings remain the property of their originating employers (clause 6).
- 13. Governing law
- All our contractual relations will be governed exclusively by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles, and any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware.
